1 INFORMATION THAT MAY BE COLLECTED

In order to use the Services, you will need to enter an email address and password, so that we may assign you a Login ID ( "ID "). After you create your ID, you will be able to use this ID to log in to the E-Psychiatry website and utilize the Services, including managing your account, searching for physicians, making appointments, and accessing any other services offered by E-Psychiatry .


When you are ready to utilize E-Psychiatry’s Services, you will also be asked to create an Account or Profile. To create the Profile, we will need some personal information such as your name, address, telephone number, date of birth, e-mail address, gender, and other pertinent data that will be available for you to share with your Healthcare Provider.


The email address that you provide to E-Psychiatry will be used to validate your account as well as to provide you with messages from your Healthcare Provider, appointment reminders, or other pertinent health related information. E-Psychiatry will not share your email address with any other third parties and will not use it for advertising or sales purposes. E-Psychiatry may create a record of the services you receive, including video and/or audio files associated with all consultations, electronic medical records that may be uploaded or created as a result of treatment, and other medical test results. For certain services, such as for telemedicine health sessions and monitoring services we will collect credit card or billing/payment account information which we maintain in encrypted form on secure servers.


When using our Services, we will ask you for certain personal information, which may include information like your name, phone number, gender, occupation, credit card or other billing information, your email address and the email address of your contacts, home and business postal addresses and website URLs. We may also ask you to provide Personal Health Information (PHI) such as your weight, blood pressure, lab results, medications, health history, medications or other PHI to E-Psychiatry or any Healthcare Providers. You may also need to provide E-Psychiatry with your insurance information, including your insurance carrier and policy numbers, certain health information, including names and addresses of healthcare providers you have seen, your reason for scheduling an appointment with a Healthcare Provider, your medical history, and any other information or data that you provide when using the Services. This information is maintained on a secured basis.


We also collect information you may provide in response to surveys and questionnaires on the Site, and any of your communications with us, including any emails, facsimile or letters may be collected as personal information. Please note that while we strive to protect your PHI from unauthorized access, use or disclosure, E-Psychiatry cannot ensure or warrant the security of any information you transmit to us on our web site.

2 PERMITTED USES AND DISCLOSURES

E-Psychiatry may use or disclose your Protected Health Information ( "PHI ") for the purposes of  treatment; payment for services and products; healthcare operations, including quality assurance activities, customer service, case management services and other programs to ensure that you receive quality care; if authorized by User; and/or as required by law .


E-Psychiatry may share your Personal Information: (i) with third parties who have agreements with us, including marketers, advertisers and other health service providers; (ii) in the event of a transfer of ownership of E-Psychiatry, merger or other similar transaction (including one in connection with any bankruptcy or similar proceedings); (iii) if required by law, or (iv) as otherwise set forth in this Privacy Policy, including as set forth below. E-Psychiatry is not and cannot be responsible for the activities or privacy policies of any third party with whom your personal information is shared.


If products and/or services are purchased or obtained from this Site, E-Psychiatry may disclose to a third party your personal information that E-Psychiatry gathers from you during the user registration process for the Site so that you do not have to enter your registration information more than once. E-Psychiatry may gather PHI primarily to share with Healthcare Providers for the purposes of diagnosis, treatment, and health care operations.


E-Psychiatry may also use and disclose PHI to tell you about different types of treatment available to you, and to inform you about other benefits and services related to your health. With your permission, E-Psychiatry may share your PHI with a family member who helps with your medical care. If you are not present or able to say no, we may use our judgment to decide if sharing your PHI is in your best interest. With your consent, E-Psychiatry may also use and disclose information for research purposes. E-Psychiatry may use and disclose your PHI when required to do so by federal, state or local law. E-Psychiatry may use and disclose your PHI to prevent a serious threat to your health and safety and that of others, but will only disclose your PHI with persons who can help prevent the threat. With your consent we may also post on our site personal testimonials and endorsements you may wish to share as a satisfied customer of E-Psychiatry.

We may also send you promotional announcements from time to time about new products and services that you might find useful. You may opt out from receiving information from us at any time and ask us to remove your contact information from our database.


3 NO COLLECTION OF PERSONAL INFORMATION FROM CHILDREN

You must be 18 years of age or older to use the Site. E-Psychiatry will delete any information from the E-Psychiatry database if we learn that the Site has received any Personal Information from anyone who is not at least 18 years old.

However, while we strive to protect your PHI from unauthorized access, use or disclosure, E-Psychiatry cannot ensure or warrant the security of any information you transmit to us on our web site.


E-Psychiatry will not give, sell, rent, or loan any identifiable personal information to any third party, unless legally required to do so. We will not voluntarily enter any agreements which require disclosure of this information.


E-Psychiatry takes commercially reasonable precautions to protect your information. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information.

Any outside businesses that contract with E-Psychiatry to provide certain services to help facilitate treatment, payment and healthcare operations to you, must enter into a Business Associate agreement with E-Psychiatry, which requires said third party businesses to protect PHI that is shared with them in accordance with the restrictions outlined in this Privacy Notice.

13ACCEPTANCE

By using this site and E-Psychiatry’s Services, you acknowledge your acceptance of E-Psychiatry’s Privacy Policy and agree to the terms described herein.
